on the processing of personal data of persons using the website www.kareleurope.ro

KAREL EUROPE S.R.L. is a limited liability company, duly incorporated and operating in accordance with the laws of Romania, having its registered office located in Bucharest, Sector 1, MONTREAL Square, No. 10, INTRANCE D, ROOM 1.14 UNO, 1st Floor, having the capacity of Personal Data Controller. 

Having regard to the provisions of EU Regulation No. 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC, hereinafter referred to as "the Regulation", which became applicable from 25.05.2018

This Privacy Notice describes the types of Personal Information we collect in connection with users' access to the website www.kareleurope.ro , the purposes for which we collect Personal Information, the other parties with whom we may process/share it, and the measures we take to protect data security. It also informs you of your rights and choices regarding your Information. Personal Information and how you can contact us to update your contact information or get answers to questions you may have about our privacy practices.

1. Types of data collected

We may collect and use different types of personal data depending on our purposes as described below:
a) your personal data, such as your name, surname, signature, position,
b) contact details, such as your name, company or organization name, service email address, company phone number, business or home address.
c) automatically: from your activity on the site, such as the date and time you visited the site, your public IP address, and other information.

2. Purpose of data collection

Depending on the purpose for which the data is used, we collect data for:
•  securing our tools: keeping our website safe and making sure that it is working properly and continuously improving;
•  the conduct of the business relationship and/or performance of the contract with the legal entity on whose behalf you are acting;
•  Legal grounds where data processing is required by law.

For each specific processing of personal data that we collect from you, we will inform you whether the provision of personal data is required by regulations or if it is necessary for the performance of the business relationship between KAREL and the company you represent, i.e. to conclude a contract; whether it is obligatory to provide us with personal data and what the possible consequences are if you refuse. 

3. Legal basis for data processing

The legal basis for processing your data may be: your consent, the performance of a contract, our legitimate interest, or the existence of legal obligations where the retrieval of data is required by law.

4. Storage of personal data

The data we collect from you is stored in Karel Romania's data center.  

How long we keep your personal data: we will store your information for as long as we are required by law. If there is no legal requirement, we will only store it for as long as necessary.

5. Access to personal data

We do not pass on, sell or transfer your data to third parties for marketing purposes outside KAREL EUROPE SRL. The data passed on to third parties is only used to provide our services to you. You will find the categories of third parties under each specific process below.
Part of the collected data we will transfer to a third party for:
•  Shipment of ordered products to customers - in this case we transfer your contact details to courier companies, transportation companies, forwarding houses, which deliver orders on our behalf.

Karel may also provide your personal data to other companies with which it is in a partnership relationship, but only on the basis of a confidentiality undertaking on their part, whereby they guarantee that these data are kept secure and that the provision of this personal information is done in accordance with the legislation in force, as follows: courier or other services, other companies with which we may develop joint programs to offer our products and services on the market, insurers.

These third parties are contractually committed to providing adequate safeguards for your personal data, which means that it will be protected in accordance with the legal requirements of the European Union.

Your personal information may also be provided to the Public Prosecutor's Office, the Police, the Courts and other authorized state bodies, on the basis and within the limits of the legal provisions and following specific requests.

6. Your Rights

The right of access means that you have the right to obtain a confirmation from KAREL as to whether or not we are processing your data, and if so, to provide you with access to this data and information about how it is processed.

The right of rectification means that you have the right to request the rectification of your personal data if it is inaccurate, including the right to complete incomplete personal data.

The right to erasure means that you have the right to obtain at any time the erasure of personal data processed by KAREL, in any of the following situations: the data is no longer necessary for the purposes for which it was collected or processed; you withdraw your consent and there is no other legal basis for the processing; you object to the processing; the data has been processed unlawfully; the data must be erased in order to comply with a legal obligation or the collection was done in connection with the provision of services.

However, your data will be kept for the finalization of the following situations: you have an open order that has not yet been shipped or has been partially shipped; the company you represent has an unpaid debt to KAREL. If you have made a purchase on behalf of the company you represent, we will retain your personal data in connection with your transaction in accordance with applicable law.

The right to restriction of processing means that you have the right to restrict processing in the following situations:
•  if you contest the accuracy of the data, for a period that allows KAREL to verify the accuracy of the data;
•  if the processing is unlawful, and you object to the deletion of your personal data, requesting instead the restriction of its use;
•  if you have objected to the processing, for the period of time during which it is ascertained whether KAREL's legitimate rights prevail over your own;
•  if KAREL no longer needs your personal data, but they are necessary to defend your rights in court.

The right to portability means that you have the right to obtain your personal data in a structured, commonly used and machine-readable format and you have the right to transmit these data to another controller.

The right to object means that you have the right to object to the processing of your personal data based on KAREL's legitimate interest. KAREL will not continue to process your personal data unless we can demonstrate a legitimate reason for the processing that overrides your interests and rights or if the processing is carried out on the basis of legal proceedings.

7. How can you exercise your rights?

We attach great importance to the protection of personal data and therefore pay particular attention to your aforementioned rights. On the basis of a written request, dated and signed, sent to Karel Europe SRL, str Piața MONTREAL, Nr. 10, Intrarea D, Incaperea 1.14 UNO, Etaj 1, Bucuresti, Sector 1, or to [email protected] you may exercise, free of charge, the following rights: to be confirmed whether or not your personal data is processed; to intervene on the data transmitted; to object to the processing of the data for legitimate and legitimate reasons related to their particular situation; to request the erasure of the data, except in the situations provided by law.

The kareleurope.ro website does not promote SPAM. Any partner/customer who has explicitly provided their email address on the kareleurope.ro website may opt to have it removed from our database.

The information you provide to us will be used for the purpose for which you have provided it, to administer, support and evaluate our services and to prevent breaches of security, the law and our contractual terms.

8. The Right to complain to a supervisory authority

If you believe that KAREL is processing your personal data incorrectly and you have a complaint about our use of your data, we would prefer that you contact us directly in the first instance so that we can address your complaint. You also have the right to lodge a complaint with the Data Protection Authority (ANSPDCP).
